- In 2019 our friend Michael Pelko was convicted of murdering his friend since childhood, Izat Morrar. He received a sentence of 55 years. His conviction was unsound, and we can prove it. We seek to have Mike Pelko exonerated.
- We have hired Ben Levitan, the country's foremost telecommunications expert on cellphones, and he has opined that Mike has an unassailable alibi to overturn his conviction. Mr. Levitan's report is attached to the filed petition linked below as exhibit C. What it basically says is that the State's cellphone experts were either incompetent or dishonest.
- MIKE'S ACTUAL INNOCENCE APPEAL PETITION CAN BE SEEN ON BOTTOM OF THIS SITE. THIS PETITION HAS BEEN FILED AND IS PENDING
- Mike was convicted by circumstantial evidence. The crucial factor in the case is the classic "can't be in two places at the same time." Izat Morrar was discovered in a Chicago alley, 50 minutes away from Mike's home in Willow Springs. What is certain is that Mike took a CME business phone call within 2 minutes of the time of the murder. What is also certain is that his phone was at his house in Willow Springs. In order to explain these inconsistencies the prosecution argued that either 1) A piece of software on the phone allowed the call to be remotely answered, or 2) the phone call at the time of the murder didn’t go through or went to voicemail. Mr. Levitan’s report conclusively proves that neither of those things happened. Never mind that the software the prosecution insisted he used was TeamViewer, which (according to multiple company reps) never has had that capability. Mr. Levitan’s report also definitively proves that the all-important phone call was live and took place at the same time as the murder. You can’t be in two places at once.
- In addition, in recent years, technology has evolved, and can now not only place the location of the phone and whether the call happened, but can also show that it was answered manually (swiped to answer), that the speaker was engaged, that the microphone was engaged, and that the phone was moving about Mike’s property as he was on the call. We have engaged the country’s leading digital forensics firm, Garrett Discovery, to prove these matters using forensic technology that was not available at the time of trial.
- We’re asking for your help to fund this effort and cover Mike’s ongoing legal costs. He has already spent almost seven years in prison for a crime he didn’t commit.
- Friends and family have already covered his legal and forensic expenses up to this point. However, costs will continue to mount until Mike is exonerated. Our legal team is highly confident that Mike will be granted an evidentiary hearing followed by a new trial. This evidentiary hearing, basically allowing new discovery, will not only bring Mr. Levitan's report to light but also bring Garrett Discovery's work to bear.
- We are committed to being transparent about how we use the donations we receive. 100% of all donations go directly to expert witnesses and attorneys' fees. If any money remains, it will be returned on a pro rata basis.
- Donations made on the site are deposited directly into an escrow account set up specifically for this purpose. Donations can be made anonymously. Our post-conviction attorneys are Filzah Pavalon and Professor Allan Ackerman.
We understand that most people faced with this decision about whether or not to help will be saying to themselves, "Man, this is the last thing I want to think about or deal with."
We get that.
Now think about being in a place like Dixon Correctional Facility. For the rest of your life.
For something you didn't do.
Thank you
